Frequently Asked Questions

Yes. You will be able to take steps to act on behalf of your mother if your mother grants a power of attorney in your favour. In order to do so, your mother will seek advice about signing a power of attorney document which will outline exactly which powers she would wish you to have on her behalf. She will require to sign the document and it needs to be registered with the Office of the Public Guardian. This can only be granted by your mother if she has capacity to do so. This means that she will require to understand the document, why she is signing it and understand the implications of it.

In the event that your mother has already been deemed to have lost capacity then you would require to apply for guardianship. For further information and to discuss which would be the best option for you then please contact one of our experienced private client solicitors.
